Lawmakers support setting up independent IPR courts(2)

Independent IPR courts are the only solution to conflicts between procedures, according to Dai Yuzhong, a member of the Committee for Internal and Judicial Affairs under the NPC Standing Committee.

Other suggestions included optimizing the administrative management on IPR protection and engaging more experts to help judges on technology issues in IPR cases.

From 2008 to June 2012, Chinese courts received 226,753 IPR-related cases and concluded 208,653, said the chief justice, adding that China had 2,731 IPR judges working in 420 regular courts by June.

According to Wang, the Supreme People's Court on Wednesday publicized a judicial interpretation to regulate the handling of civil cases concerning the right of information's communication through the Internet.

The right of information's communication through the Internet is regarded as an important civil right of copyright owner, according to Wang.

However, the rights infringers sometimes set up the Internet server abroad to evade the administration of China's courts, Wang mentioned.

The interpretation stipulates, if the infringers constitute tort in China by actions abroad, and the residence of the defendant locates abroad, China's courts have the jurisdiction over the tort cases, said Wang, adding this will be convenient for the obligee to file a suit at home.

The interpretation will take effect on Jan. 1, 2013.
